Income tax — voluntary disclosure

My clients were an elderly couple, in their 80s, who had failed to file their income tax returns for 12 years. Their income each year was not huge, but the potential liability over so many years was quite large, especially with penalties and interest.

The clients came to me with their son, who was trying to help them get their affairs in order. I prepared a Voluntary Disclosure to the CRA. I made convincing arguments as to why the CRA should accept only the past 6 years of returns instead of all 12 years, and should cancel part of the interest as well as all the penalties (as is standard for a voluntary disclosure).

The CRA agreed, accepted and processed the 6 years of returns that I filed, cancelled all penalties and reduced the interest, and did not pursue my clients for the earlier years.

The result was a substantial savings for them.
